The client agrees to all, and not limited to the outlined terms and conditions below with regards to our website and the web services we offer.
PRIVACY
CMS Web Design Solutions will never pass on or resell your contact details including email addresses or any other personal information that we may acquire from you, unless you have given full consent in writing. We will never share your information with third parties for commercial purposes and are not affiliated with or to any advertising companies. The client does agree that we are free to use their project for portfolio or advertising purposes.
PAYMENTS
Payment of 50% of the work is required before any further work will be carried out. This is not refundable and covers set-up and administration costs. To protect both parties no further work will be carried out until this deposit is made, once the project briefing session has commenced and both parties are happy to go ahead with the said work. The client also agrees that full payment of the remaining 50% must be payed once work has been completed. We are happy to resolve any changes or problems upto a month after the work has ended for free, however once this period is over and the client requests amendments or alterations or encounters more problems the client agrees they will be charged a minimum rate of £25 per hour, with a minimum charge of £25 per work. Some of our services are available at a monthly rate, where this is present, full payment must be made before any work is started.
Failure to pay will result in complete suspension of all services, for which we can not be held liable for any loss of earnings as a result.
Payments can be made by cash, cheque or by credit/debit card using Paypal. We currently accept Paypal for all of our online transactions. All online transactions are dealt with through secure servers at Paypal. Please be assured that at no time are your credit card details divulged to us. The client also agrees that we can not and will not be held liable for anything related to their paypal account as a result of providing payment through Paypal's secure server.
LIABILITY
We can not and will not be held liable, including for any loss of earnings, as a result of any work carried out, domain hosting problems, or mistakes on our part or the clients. We will work to rectify any problems or in more severe cases undo the work carried out to a certain degree. The client agrees we can not and will not be held liable for any of our services.
OUTSOURCING
The client understands that we may be required to outsource some of the project to another professional, however we will only ever outsource said work to people we have built up a trust with and no personally. This however does not inflate the costs in any way as the professional is paid a percentage of the total project cost. SEO / ANALYTICAL SERVICES
Where we offer SEO (search engine optimisation) or analytical services we can not and will never guarantee results, we do not guarantee and will never guarantee a customer a number 1 position in google or that we can reduce your bounce rate to 0% and as a result can not be held liable for any fluctuation or under-performance of your website, what we will do is work with you to advise and make changes which should in time help your website be more search engine friendly and more customer focused and functional.
WEBSITE HOSTING / DOMAIN MANAGEMENT
All domains registered will be registered under the name of the client, giving the client full ownership of all domains registered through us as part of our services. Where the client requires hosting services, we provide these at rates based on level of service with the lowest cost being of £10.00 pcm. The client is also aware that failure to pay for their domain hosting will result in the loss of their site during this period for which we can not be held liable to any loss of earnings as a result of a clients neglect. All domains will be passed to the client to re-register when they are due for renewall if the client wishes we may offer a service to re-register their domains automatically which will be charged for the privilege, however we can not be held liable for any problems with domain renewal.
COPYRIGHTS
All clients must ensure they have full copyright ownership for any content, images, logos and design works (where applicable) before we can place them on their website. Where an ecommerce website is requested and the client is selling a product they dont own, the client must have permission to use any images, descriptions with regards to the products they are looking to offer for sale, otherwise we will not carry out any work, until copyright is setup or permission has been granted. The client agrees they hold and will take full responsibility for any issues and we are not and can not be held liable for any damages as a result of breach of copyright as it is the clients responsibility to ensure they abide by the laws.
We reserve the right to amend these terms and conditions or the pricing for any of our web services, at any time, without warning.
